Understanding Cannabis Taxes in California

One of the biggest advantages of California’s medical cannabis program is the potential for tax savings.


Although recreational cannabis is legal throughout California, cannabis purchases are still subject to several different taxes. Understanding how these taxes work can help patients make informed decisions about obtaining a medical marijuana recommendation and whether applying for a California Medical Marijuana Identification Card (MMIC) may be beneficial.


Many patients are surprised to learn that a physician recommendation alone does not provide a sales tax exemption. Under current California law, the sales tax exemption generally applies only to qualified patients who present a valid California-issued MMIC together with a valid government-issued ID at the time of purchase. The cannabis excise tax still applies.

California Cannabis Excise Tax

As of 2026, the statewide cannabis excise tax is 15% of the retail gross receipts. This tax generally applies to both recreational and medical cannabis purchases.  

Unlike sales tax, medical cannabis patients are generally not exempt from the cannabis excise tax, even if they have an MMIC.  


California Sales Tax

Most retail purchases in California are subject to sales tax.

However, California provides an important benefit for certain qualified medical cannabis patients.

If you present:

  • A valid California Medical Marijuana Identification Card (MMIC)
  • A valid government-issued photo ID

your purchase of qualifying medicinal cannabis is generally exempt from California sales tax.  

This exemption can result in meaningful savings for patients who purchase cannabis regularly.


Does a Physician Recommendation Eliminate Sales Tax?

No.

This is one of the most common misunderstandings among medical cannabis patients.

A physician recommendation alone allows a qualified patient to participate in California’s medical cannabis program, but it does not qualify the patient for the state sales tax exemption.

To receive the sales tax exemption, California generally requires:

  • A valid California Medical Marijuana Identification Card (MMIC)
  • Government-issued identification presented at the time of purchase

Without an MMIC, sales tax generally still applies.  


Local Cannabis Taxes

In addition to statewide taxes, many cities and counties impose their own local cannabis business taxes.

Local taxes vary considerably throughout California.

Some communities have relatively low local taxes, while others impose substantially higher rates.

Because of these differences, patients may notice that identical products cost different amounts depending on the dispensary’s location.

Generally pay:

Qualified Medical Patients with an MMIC

Generally pay:

May qualify for an exemption from California sales tax on qualifying medicinal cannabis purchases when presenting a valid MMIC and government-issued ID.
