California has recognized the medical use of cannabis since the passage of Proposition 215 (The Compassionate Use Act of 1996) and later expanded the program through the Medical Marijuana Program Act (SB 420). 

Today, qualified patients may obtain a physician’s recommendation when medical cannabis is appropriate for their condition.  

Although recreational cannabis is now legal for adults 21 years of age and older, California continues to maintain a separate medical cannabis program. A physician’s recommendation remains an important part of that program because it documents that cannabis is being used for medical purposes under the care of a licensed physician.

Unlike recreational cannabis purchases, a medical recommendation begins with a physician evaluation.

A valid physician recommendation allows qualified patients to purchase medical cannabis from licensed California dispensaries that serve medical patients.

One of the most important legal benefits of obtaining a physician recommendation is that it allows a qualified patient to apply for a California Medical Marijuana Identification Card (MMIC) through their county health department.  

The MMIC is optional, but it provides additional legal benefits that a physician recommendation alone does not which includes:

• State-issued medical cannabis identification.
• Eligibility for California’s sales tax exemption on qualifying medicinal cannabis purchases.
• Verification through California’s MMIC program.
• Recognition as a qualified patient within California’s Medical Marijuana Identification Card Program.

This is one of the most misunderstood areas of California law.

A physician recommendation by itself does NOT exempt a patient from California sales tax.

To qualify for the state sales tax exemption on qualifying medicinal cannabis purchases, a patient must present:

• A valid California Medical Marijuana Identification Card (MMIC), and
• A valid government-issued photo identification.

Patients who have only a physician recommendation generally continue to pay sales tax. The cannabis excise tax still applies even when an MMIC is presented.  

Unlike recreational cannabis purchases, obtaining a recommendation provides an opportunity to discuss medical cannabis with a licensed physician.
